Inconciliáveis

2310. Dissolution of the marriage or legal separation of the parties may be based on either of the following grounds (…) :

(a) Irreconcilable differences, which have caused the irremediable breakdown of the marriage. (...)

2311. Irreconcilable differences are those grounds which are determined by the court to be substantial reasons for not continuing the marriage and which make it appear that the marriage should be dissolved.

Isto é o que diz a legislação civil da Califórnia, citando um dos motivos mais frequentes nomeadamente para o divórcio dos «famosos»: as «diferenças inconciliáveis». Parece-me óbvio que nenhuma relação sobrevive a alguma coisa que seja «irreconciliável», mas suspeito dessa referência às «diferenças», diferenças é o que há mais, num casal as diferenças são um facto absoluto e ininterrupto, sejam ou não «conciliáveis», e nem sequer é um defeito. Mas dizer que «diferenças inconciliáveis» são aquelas que «o tribunal considere como razões substanciais para que o casamento não continue» parece-me má técnica legislativa,tautologia, ou talvez um pessimismo já a caminho do tédio.
